These General Conditions of Sale apply exclusively to current and future commercial relations concluded between,

and on the other hand,

By any natural or legal person making a purchase via the wellnessmarket.fr website, hereinafter referred to as "the customer".

Any condition not in accordance with our general terms and conditions which the customer has formulated will be rejected unless the seller has expressly and in writing acknowledged its applicability.

Tariff / Products

To complete its purchase on the site, the customer must certify that he or she is a major and accept these Terms and Conditions. The customer is solely responsible for the use of the purchased products.
The prices displayed on the website are in Euros all taxes included.

The products offered on the site are described and presented with the greatest accuracy.
Photos, texts, information or characteristics of the products in the catalogue are not contractual.
If, despite all our precautions, errors could occur, the seller could not under any circumstances be engaged in this fact. Except in the case of warranty, any transaction between the seller and its customers, which is not contested within 3 weeks of receipt of the order, cannot give rise to a claim.

The offers offered are valid as long as they are posted on the wellnessmarket.fr website, and within the limits of available stocks.
In case of unavailability of products after placing the order, the customer will be informed by e-mail or telephone.
The seller will offer to replace the product ordered not available with a similar product.

In the absence of acceptance, the order will be cancelled; if the payment has already been received, the customer will be refunded within a maximum of 15 days.

The VERIFONE CHECKOUT secure payment system is used by the website www.wellnessmarket.fr which accepts the main European Banking Cards: Visa, EuroCard, MasterCard, CB, Amex and all the cards whose logo appears in the footer of the site.

VERIFONE CHECKOUT meets the highest certification standards to ensure payment security. The bank information that the buyer transmits, encrypted with his own computer, will never circulate in plain form on the Internet.

All information exchanged to process payment is encrypted using the S.S.L. (Secure Socket Layer) protocol.

The 3D Secure protocol also strengthens the authentication of the payment card holder.

A buyer's order will only be considered effective when the payment centre has given its consent.

In case of refusal by VERIFONE CHECKOUT, the order cannot be validated and will be cancelled. The Wellness Market Customer Service will then inform the customer concerned of the bank's refusal by e-mail.

Delivery method

Your order will be delivered to the address you indicated at the time of your order.
The price of the transport will be automatically calculated and updated according to the mode of delivery, the item and the place of delivery selected in your cart.

The announced delivery times are the average times observed in recognized carriers such as the Post Office and we cannot be held responsible for any delay by the carrier in relation to the announced deadlines.
These deadlines start with the processing of your order by our logistics department, any order in stock placed and settled before noon being processed and shipped the same day.

In accordance with the Châtel law, the delivery deadline is 30 days after receipt of your payment.

Shipping and delivery of orders

All valid orders are prepared and shipped within 24 hours of validation (payment received). The products shipped are protected in recyclable packaging, adapted to their size, resistant and discreet, without any indication of their contents.

When finalizing your order on our website, we will offer you, depending on the nature of the products in your shopping cart and your delivery address, the choice of different delivery methods. Home delivery for signature is available for all products, Relay Point delivery is available for the vast majority of products offered on the site.

You can request to change the delivery address of your order, only before it is shipped, by sending an email from the mailbox used during your order to contact@wellnessmarket.fr, specifying the name associated with the order, the order number and the new delivery address to be taken into account. Any order already shipped (confirmation mail sent) will not be subject to a change in the delivery address of the order concerned.

Upon shipment of your order, you will receive by email a confirmation of dispatch of your order, containing an online link tracking your delivery, allowing you to track in real time the delivery of your order to the delivery address indicated.

Orders are delivered by recognised national carriers with online tracking. Depending on the nature of the products ordered and your delivery address, you will be delivered by Recommended Letter (for Flowers and Resins) or Colissimo, DPD or DHL (for all other products).

If you are absent from the delivery service, the carrier will offer you, via the online tracking link, to reprogram the delivery or pick up your parcel at a Post Office or Relay Point of your choice close to the delivery address you have planned.

Return procedure

You have a legal deadline of up to 14 days from the date of delivery of the product(s) concerned, to make a return request (exchange or refund request).

To make a return request (exchange or refund), please send an email to the contact address @ wellnessmarket.fr indicating your name, your order number, the product(s) you wish to return and the nature of your request for each product (exchange or refund).

You will receive in response to your request, and within a maximum of 72 hours, an email confirming your acceptance or refusal of your request, and if your request is accepted, a link in the email allowing you to print your transport label back. The return transport costs remain at the expense of the customers.

Conditions for acceptance of Returns

To be accepted, a return application must meet all of the following conditions:

– The return request must be complete (specifying the customer name, the order number, the product(s) to be returned, and the nature of your request for each returned product (exchange or refund).
– The return request must be sent by email to contact @ wellnessmarket.fr within 14 days of delivery of the product(s) concerned by the return request.
– The returned product(s) must be complete, packed in its original intact packaging(s) and must not have been used or opened. A return request for a product that has been used or opened cannot under any circumstances be accepted.

Transport information

Delivery will be made by our carriers in the delivery areas accepted by Wellnessmarket.fr.

Delivery is effected by direct delivery of the product to the notified consignee, or, in case of absence, to another person authorized by the customer.

For reasons of availability, an order can be delivered to the customer in several times. The customer then pays only one delivery. If the customer wishes to be delivered in two separate delivery locations, he must place two orders, with the related delivery costs.

It is considered a case of force majeure that relieves the seller of its obligation to deliver: war, riot, fire, strikes, weather, accidents, impossibility to be supplied, all other natural disasters even if the conditions of unpredictability, and externality are not fulfilled.

Transfer of ownership

The transfer of ownership of the goods to the customer is suspended until full payment of the price.

In the event of a deferred payment, Wellnessmarket.fr will retain ownership of the goods until they are paid in full under the conditions established by contract, even in the case of collective proceedings against the customer, in accordance with articles L.621-122 et seq. of commerce.

Delivery conditions

The deadlines indicated on the site and in the general conditions of sale are average.
Exceeding delivery times cannot give rise to damages, withholding or cancellation of pending orders.
However, if after the delivery deadline the product has not been delivered, for any other cause than a case of force majeure described in the paragraph "Transportation Information", the sale may be cancelled, at the request of the customer, within 60 days, by registered AR letter.
The seller will then return the settlement to the customer, excluding any other compensation or damages.

The seller reserves the right to cancel an order in case of too great a difficulty for the carrier to make the delivery.

The delivery is considered to be carried out on the date of first presentation of the order at the address indicated on the order form.

During delivery, the customer must ensure that the products were not damaged during transport.
If the client finds an apparent anomaly, they can either accept or refuse the products.
In both cases, he must report the apparent anomalies on the carrier's delivery order and within three working days by registered AR letter to the carrier, and send a copy to SEREMINE SAS, 17 rue Jean Perrin, 17000 La Rochelle (France).

In the event of delivery by postal services, the same precautions shall apply. If an anomaly is found, an anomaly record must be completed by the client.

If the products have been accepted, the customer will be able to contact our services in order to organize a return of the product according to the formalism described in the article below "satisfied or refunded".

Satisfied or refunded

Le client dispose d’un délai de 14 jours à compter de la réception de la commande pour formuler une demande de rétractation par e-mail à l’adresse contact @ wellnessmarket.fr.

Si votre retour est accepté, le remboursement de vos articles intervient au plus tard 14 jours après la réception du produit retourné (auxquels il faut ajouter les éventuels délais interbancaires, allant de 3 à 7 jours).

Un email vous est envoyé lorsque votre retour a été enregistré et le remboursement mis en place par notre service clients.

En cas de demande d’échange ou de remboursement, le client renvoie à ses frais l’article neuf dans son emballage d’origine, intact, accompagné de tous les accessoires éventuels, notices d’emploi, documentations, facture d’achat.

La première étape consiste à nous contacter au préalable par e-mail à l’adresse contact @ wellnessmarket.fr afin d’obtenir un accord de retour ainsi que l’adresse du lieu de retour.

Attention, tout article renvoyé sans nous avoir contacté au préalable sera systématiquement refusé.
Si l’article est renvoyé ouvert, incomplet ou endommagé à Wellnessmarket.fr, une décote de son prix sera appliquée selon le diagnostic réalisé par le service SAV.
wellnessmarket.fr justifiera auprès du client l’application de cette décote en lui communiquant un document dressé par son service après vente.

En cas d’exercice du droit de rétractation, nous nous engageons à vous rembourser votre commande, ou à vous échanger les produits ne correspondant pas à votre commande (défectueux ou non conformes).

En cas de demande de remboursement, le remboursement sera réalisé, selon votre mode de règlement initial, par virement, chèque ou recréditation de votre carte bancaire, et ce dès que le diagnostic de notre service SAV aura été effectué.

Garantie

Les informations relatives à la garantie contractuelle sont présentées sur chaque fiche produit du catalogue.

En toute hypothèse, le client bénéficie de la garantie légale d’éviction des vices cachés (art. 1625 et suivants du code civil).

Les garanties ne couvrent pas :

  • le remplacement de pièces consomptibles les pannes afférentes aux accessoires,
  • les pannes provenant de pièces non conformes à celles préconisées par le SAV de la marque de l’appareil

Sont également exclus les défauts et leurs conséquences dus :

  • à l’intervention d’un réparateur non agréé par la marque
  • au non-respect des instructions indiquées dans les notices d’utilisation et d’entretien
  • à toute erreur de manipulation ainsi qu’au manque d’entretien de l’appareil à une utilisation non conforme à l’usage pour lequel le produit est destiné, et notamment une utilisation à des fins professionnelles ou collectives. (sauf gamme pro et semi-pro)à toute cause d’origine extérieure.

En cas de demande d’activation de la garantie, l’acheteur doit s’adresser directement au service consommateur de la marque concernée.
Cependant, l’acheteur peut également nous contacter par e-mail à l’adresse contact @ wellnessmarket.fr pour tout problème technique ou demande d’information complémentaire, le Service Clients de wellnessmarket.fr étant en relation directe et permanente avec les services consommateurs des marques et fournisseurs proposés sur le présent site.

Pour pouvoir activer la garantie ou l’extension de garantie, il est impératif que l’acheteur ait conservé l’emballage d’origine du produit ainsi que la facture constituant la preuve d’achat du produit.

La langue du présent contrat est la langue française.

A l’exception des personnes physiques pour lesquelles les tribunaux compétents seront déterminés par les dispositions du code de procédure civile, en cas de litige le tribunal de commerce sera seul compétent.

Cette attribution de compétence s’appliquera également en cas de pluralité de défendeurs ou d’appel en garantie.

Les produits vendus sur le site wellnessmarket.fr sont réservés exclusivement à un public majeur (18 ans et plus).
Les clients du site wellnessmarket.fr déclarent expressément être majeur au moment d’accéder au site, et le confirment à nouveau en acceptant les présentes conditions générales de ventes lors du passage de leur commande.
